12-11-24 PRESS RELEASE – Self-immolated social protest activist Moshe Silman and the Tel-Aviv District Court – double books in Net HaMishpat
סילמן ומחוזי תל-אביב – ספרים כפולים בנט המשפט
In his last letter, Silman levels serious accusations against the Court. The evidence shows that he was indeed subjected to simulated litigation. New evidence from the purported appeal file shows 5 purported decisions from recent months, which appear in the case management system of the court, but not in the public access system, and which were never delivered through service to the filer in the matter. Such five (5) purported decisions by Judge Hagai Brenner appear in the appeal from his own decision. The case of Moshe Silman uniquely documents the way that new electronic record systems in the Israeli courts, and Net HaMishpat in particular, are used as double books, out of compliance with basic notions of fair and public hearings and national tribunals for protection of rights. Over the past decade, in parallel to the implementation of new electronic record systems, the courts of the State of Israel have been corrupted in an unprecedented manner. During this period Aharon Barak and later Dorit Beinisch served as Presiding Justices of the Supreme Court.
במכתבו האחרון, העלה סילמן טענות חמורות נגד בית המשפט. הראיות מצביעות על כך שאכן בעניינו התנהלו הליכים למראית עין. כתבים חדשים שנמצאו בתיק הערעור כביכול, מראים 5 החלטות כביכול מן החדשים האחרונים, המופיעות במערכת ניהול הכתבים של בית המשפט, שאינן מופיעות במערכת המקוונת לניהול גישת הציבור לכתבים, ושלא הומצאו לבעל העניין בהחלטות. חמש (5) החלטות כביכול אלה של השופט חגי ברנר מופיעות בתיק הערעור כביכול, שנבע מהחלטתו הוא. מקרהו של משה סילמן חשף את הדרכים בהן מערכות הכתבים האלקטרוניים של בתי המשפט בישראל, ובמיוחד נט המשפט, משמשים כספרים כפולים, תוך הפרת מושגי היסוד לגבי זכויות האדם למשפט הוגן וציבורי ולבתי משפט לאומיים להגנה על זכויות. בעשור האחרון, במקביל להנהגת מערכות כתבים אלקטרוניים חדשות, הושחתו בתי המשפט בישראל בצורה חסרת תקדים. בתקופה זאת כיהנו כנשיאי בית המשפט העליון אהרון ברק ודורית בייניש.
